These Terms of Service (“Terms”) govern your use of the Krystl platform operated by Krystl (“we,” “our,” or “us”). By using Krystl, you agree to these Terms.
1. The Service
Krystl is a marketing decision support platform for small business owners. It connects to your marketing platforms (Meta Ads, Google Analytics, Google Ads, etc.) to generate health scores, insights, and prioritized recommendations. Krystl does not run, create, or manage ad campaigns on your behalf.
2. Account Registration
You must create an account to use Krystl. You are responsible for maintaining the security of your account. Notify us immediately at support@krystl.io if you believe your account has been compromised. You must be at least 18 years old and authorized to conduct business to register.
3. Subscription Plans and Payment
- Free Plan: Access to core features at no charge, subject to usage limits.
- Paid Plans: Starter ($79/mo), Growth ($149/mo), Advisor ($299–399/mo). Billed monthly or annually.
- Payments are processed by Stripe. By subscribing, you authorize recurring charges.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Refunds are not provided for partial billing periods.
4. Connected Third-Party Platforms
When you connect Meta Ads, Google Analytics, Google Ads, or other platforms, you authorize Krystl to access your data from those platforms on a read-only basis. Krystl does not create, modify, or delete any campaigns, ads, or data on connected platforms. You are responsible for maintaining valid authorizations with connected platforms.
5. Acceptable Use
You agree not to:
- Use Krystl for illegal purposes or in violation of any applicable laws.
- Reverse engineer, copy, or resell the Krystl platform.
- Share your account credentials with unauthorized parties.
- Upload malicious content or attempt to disrupt the service.
- Use Krystl to collect or process data of individuals without appropriate legal basis.
6. AI-Generated Content Disclaimer
Krystl uses artificial intelligence to generate marketing insights and recommendations. AI-generated content is clearly labeled within the platform. AI outputs are provided for informational purposes only and do not constitute professional marketing, legal, or financial advice. Krystl does not guarantee the accuracy or completeness of AI-generated insights. You are responsible for all business decisions you make based on Krystl outputs.
7. Intellectual Property
Krystl and its underlying technology, including the DMMM (Digital Marketing Measurement Model) engine, scoring algorithms, and platform design, are the intellectual property of Krystl. Your business data remains yours. By using Krystl, you grant us a limited license to process your data solely to provide the service.
8. Privacy
Your use of Krystl is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Krystl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service. Our total liability to you for any claim arising from these Terms or your use of Krystl shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Krystl platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your account for violation of these Terms. Upon termination, your data will be deleted within 30 days.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Texas.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a platform notice at least 14 days before they take effect. Continued use of Krystl after changes constitutes acceptance.
